Our Partner, Nan Muhammad Ridhwan, accompanied by Legal Associate, Muhammad Hibri and Pupil-in-Chambers, Wan Amiratul Husna from our Shariah Practice Group, obtained a Hibah Verification Order in the Syariah High Court in Kuala Lumpur, favoring the Plaintiff, a member of a royal family, regarding an immovable property valued at approximately RM2 million in Hulu Langat (“the Property”).


The Plaintiff’s application to verify the Hibah is based on a Hibah agreement executed by both the Plaintiff and the Defendant in October 2023.

After considering the submissions from the counsels, the High Court agrees that the parties have fulfilled all the conditions and requirements of the Hibah, and the documentary evidence of the Hibah is complete, thus rendering the Hibah valid.

The High Court:
(i) Granted the Plaintiff's claim under Section 46(2)(b)(vi) of the Administration of Islamic Law (Federal Territories) Act 1991;
(ii) Confirmed the validity of the Hibah Agreement executed by the Plaintiff and the Defendant according to Islamic Law;
(iii) Declared that the Property is no longer subject to Faraid after the Defendant's demise;
(iv) Issued an order for the transfer of ownership of the Property in compliance with sections 420 and 421 of the National Land Code 1965, to facilitate the registration of the transfer of ownership at the Land Office.
